Terms and conditions

These terms apply to the use of our website and to goods and services supplied by Watkins Welding and Engineering Limited. A quotation or written agreement may contain additional project-specific terms. If there is a conflict, the project-specific terms agreed in writing will take priority.

Nothing in these terms affects a consumer’s statutory rights.

References to “we”, “us” and “our” mean Watkins Welding and Engineering Limited. References to “you” and “your” mean the customer.

2. Quotations

Unless stated otherwise, quotations remain valid for 30 days from their date.

A quotation is based on the information, measurements, drawings, photographs and access details available when it is prepared. If these details are incorrect or incomplete, the price, specification or completion date may need to change.

A quotation does not create a binding contract until it has been accepted by you and confirmed by us.

Obvious errors in a quotation, website listing or price may be corrected before a contract is accepted.

3. Orders and contracts

For online purchases, submitting an order is an offer to buy from us. An automatic order acknowledgement does not necessarily mean that we have accepted the order.

A contract is formed when we send an order confirmation, confirm acceptance in writing or begin supplying the goods or services with your agreement.

We may decline or cancel an order before acceptance if:

  • The product is unavailable.
  • We cannot deliver to the requested location.
  • An incorrect price or description has been displayed.
  • Required information has not been supplied.
  • We cannot safely or lawfully complete the work.
  • We reasonably suspect fraud or misuse.

If we decline an order after receiving payment, we will refund the amount paid.

4. Prices and payment

Prices will be those shown on the website or within the accepted quotation.

Prices include VAT. Delivery, installation, access equipment, surveys and other additional costs will be identified before the order is confirmed wherever reasonably possible.

Payment terms will be stated on the website, invoice or quotation. Bespoke projects may require a deposit and staged payments.

Deposits contribute towards materials, design, administration and reserved production time. If a project is cancelled, we may retain only the reasonable costs and losses we have actually incurred, subject to your statutory rights.

Late payment may delay fabrication, delivery or installation. For business customers, we may charge statutory interest and recovery costs where permitted by law.

Goods remain our property until we have received full payment, although responsibility for their care may pass to you earlier as described below.

5. Product descriptions

We take reasonable care to ensure website descriptions, photographs and measurements are accurate.

Because many items are handmade or fabricated to order, minor variations in colour, grain, finish, weld appearance and dimensions may occur. These are not normally defects where they do not materially affect the agreed appearance, safety or use of the item.

Wood, steel and other natural or manufactured materials may change slightly with age, weather, temperature and use.

Website photographs are illustrative and colours may vary between screens.

6. Bespoke and made-to-order goods

You are responsible for checking and approving any final drawings, measurements, finishes, colours and specifications supplied for approval.

Once bespoke production or material ordering has begun, changes may result in additional costs and delays. We will explain and seek approval for significant additional costs before proceeding.

The usual consumer right to cancel a distance contract does not apply to goods made to your specifications or clearly personalised. This does not affect your rights if the goods are faulty, incorrectly described or do not match the agreed specification.

7. Measurements and customer-supplied information

Where you supply measurements, drawings or specifications, you are responsible for ensuring they are complete and accurate.

If we carry out a survey, our measurements relate only to the areas reasonably visible and accessible at the time. Additional work may be required if hidden structures, services, defects or site conditions are discovered.

You must tell us about known underground or concealed services, hazardous materials, access restrictions and structural concerns that could affect the work.

8. Delivery

Delivery charges and estimated times will be shown on the website or stated in your quotation.

Dates are estimates unless we expressly agree a fixed date in writing. We will make reasonable efforts to meet estimated dates but may be affected by material shortages, weather, access problems, supplier delays or other circumstances outside our reasonable control.

For consumers, goods normally become your responsibility when they are delivered to you or a person you nominate. Ownership does not pass until full payment has been received.

You must inspect deliveries promptly and notify us as soon as reasonably possible of visible damage, missing items or an incorrect delivery.

9. Installation and site access

Where installation is included, you must provide:

  • Safe and reasonable access to the site.
  • A suitable working area.
  • Accurate information about the property and relevant hazards.
  • Any permissions or approvals that are your responsibility.
  • Access to electricity, water or other facilities where reasonably required.
  • Clear access for delivery vehicles, equipment and materials.

Unless expressly included in our quotation, you are responsible for planning permission, building regulations approval, landlord approval, listed-building consent and other permissions.

We may suspend work if conditions are unsafe or significantly different from those described. Reasonable additional costs caused by access problems, delays, unsafe conditions or incorrect customer information may be charged after discussing them with you.

10. Variations and additional work

Changes to the agreed work should be confirmed in writing.

Additional work, changed specifications, unforeseen conditions or customer-requested alterations may affect the price and completion date. We will explain material changes and obtain approval before carrying out chargeable additional work, except where urgent action is reasonably required to make the site safe.

11. Cancellation rights for consumers

This section applies when you are acting mainly outside your trade, business, craft or profession.

For most standard goods bought online or at a distance, you normally have 14 days after receiving the goods to tell us that you wish to cancel. You then normally have a further 14 days to return them.

For many service contracts agreed online, by telephone or away from our business premises, you normally have 14 days from the date the contract is made to cancel.

If you ask us to begin a service during the cancellation period and then cancel, you may have to pay a reasonable amount for work properly completed before cancellation.

The cancellation right may not apply to:

  • Goods made to your measurements or specifications.
  • Clearly personalised goods.
  • Urgent repairs or maintenance specifically requested by you, to the extent permitted by law.
  • Services fully performed during the cancellation period where you expressly requested early performance and acknowledged that your cancellation right would be lost once the service was completed.

These exceptions do not remove your rights where goods or services are faulty, incorrectly described or not provided with reasonable care and skill.

12. Returns and refunds for standard goods

Before returning an item, please contact us for return instructions.

Unless the item is faulty or we agree otherwise:

  • You are responsible for returning the goods safely.
  • You are responsible for the direct cost of return.

  • You may inspect goods as you would in a shop, but we may reduce a refund if unnecessary handling has reduced their value.

When a valid cancellation applies, we will refund the product price and the cost of standard outbound delivery. Extra delivery costs resulting from your choice of an enhanced service are not normally refundable.

Refunds will be made within the legally required period, normally within 14 days of receiving the returned goods or evidence that they have been sent back.

13. Faulty goods and services

We are under a legal duty to supply goods that conform to the contract and services carried out with reasonable care and skill.

If you believe something is faulty, damaged, incorrectly described or does not meet the agreed specification, contact us promptly with:

  • Your name and order or invoice number.
  • A description of the problem.
  • Photographs where appropriate.
  • The date the issue was discovered.

We may need to inspect the item or installation before deciding the appropriate remedy.

Depending on the circumstances and your legal rights, the remedy may include repair, replacement, repeat performance, a price reduction or refund.

Damage caused by misuse, unauthorised alteration, unsuitable maintenance, normal wear and tear, corrosion outside the agreed specification or failure to follow care instructions is not treated as a manufacturing defect.

14. Guarantees

Any specific guarantee will be described in the relevant product listing, quotation or warranty document.

A commercial guarantee is additional to, and does not replace, a consumer’s statutory rights.

15. Customer-supplied items and repairs

Where we repair, modify or weld an existing item, hidden defects, corrosion, contamination or previous repairs may only become apparent after work begins.

We will take reasonable care of items left with us but cannot guarantee that an existing item is suitable for repair until it has been inspected.

We are not responsible for pre-existing defects or failures in parts we did not supply or repair.

16. Intellectual property

Website content, branding, text, photographs and original designs belong to us or are used with permission. They may not be copied or used commercially without written permission.

Unless otherwise agreed, we retain ownership of our original fabrication methods, working drawings and designs. You may use completed drawings and products for the project for which they were supplied.

You confirm that you have permission to provide any drawings, photographs, logos or designs you ask us to reproduce.

17. Project photographs

We will not deliberately publish information identifying a private customer or their address without permission.

We may ask to photograph completed work for our records, website or portfolio. Where consent is required, you may refuse or withdraw permission for future publication by contacting us.

18. Liability

We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill.

We are not responsible for loss that could not reasonably have been anticipated when the contract was made, or for losses caused by inaccurate information, unsafe site conditions or failures outside the agreed scope of work.

If you are a consumer, we do not exclude liability where doing so would be unlawful, including liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Breach of your statutory consumer rights.
  • Defective products where liability cannot legally be excluded.

We are not responsible for business losses suffered by a consumer.

Business customers should ensure they have appropriate insurance for business interruption, loss of production and other commercial risks.

19. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, including severe weather, fire, flood, industrial disputes, transport disruption, material shortages, supplier failures, utility failures, government restrictions or emergencies.

We will contact you where reasonably possible and take reasonable steps to minimise the effect of the delay.

21. Website availability

We aim to keep our website available and accurate but do not guarantee uninterrupted access. We may change, suspend or remove website content without notice.

Information on the website is general and should not be treated as technical, structural or safety advice for a particular project.

22. Personal information

We process personal information in accordance with our Privacy Policy.

23. Changes to these terms

We may update these terms. The terms applying to an order or contract will normally be those in effect when that order or contract was accepted, unless a change is required by law or agreed with you.

24. Governing law

These terms are governed by the laws of England and Wales.

If you are a consumer, you may bring proceedings in the courts applicable to where you live as permitted by law. If you are a business customer, the courts of England and Wales will have exclusive jurisdiction unless agreed otherwise in writing.
